Terms of Use & Acceptable Use Policy

1. Anti-Spam & Acceptable Use Policy (AUP)

MailMonk maintains a zero-tolerance policy for spam. You agree to use MailMonk exclusively for sending emails to recipients who have explicitly opted-in to receive communication from you. You are strictly prohibited from:

• Sending unsolicited bulk email (spam).
• Using purchased, rented, scraped, or third-party email lists.
• Sending illegal, pornographic, harassing, or malicious content.
• Failing to include a functional, single-click unsubscribe link in marketing or bulk campaigns.
• Failing to include your valid physical mailing address in bulk campaigns.

2. Compliance with Laws

You are solely responsible for ensuring your use of MailMonk complies with all applicable local, state, national, and international laws, including but not limited to:

• The CAN-SPAM Act (USA)
• The General Data Protection Regulation (GDPR) (EU)
• Canada's Anti-Spam Legislation (CASL)

3. Enforcement & Account Suspension

To protect our infrastructure and deliverability, MailMonk monitors sending metrics. We reserve the right to instantly suspend or terminate your account without notice or refund if you exceed industry-standard thresholds, including but not limited to:

• A spam complaint rate exceeding 0.1%.
• A hard bounce rate exceeding 5%.
• Detection of automated spam traps or honeypot addresses in your recipient lists.

4. User-Generated Content & Liability

All emails sent through MailMonk are the sole legal responsibility of the user. We do not monitor, endorse, or verify email content prior to dispatch. MailMonk acts solely as a technical conduit for your communications and assumes no liability for the content you distribute.

5. Indemnification

You agree to indemnify, defend, and hold harmless Doubbletap Technology Solutions, its officers, directors, and infrastructure partners from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, or fines (including attorney's fees) arising from:

• Your violation of these Terms of Use or the AUP.
• Your violation of any third-party right, including privacy or intellectual property rights.
• Your violation of any applicable anti-spam or data protection law.

6. No Warranties

MailMonk is provided on an “AS IS” and “AS AVAILABLE” basis. We disclaim all warranties of any kind, whether express or implied. We do not guarantee uninterrupted service, specific inbox placement rates, or that the service will be error-free.

7. Limitation of Liability

In no event shall Doubbletap Technology Solutions or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of, or inability to access or use, the service.

8. Modifications to the Terms

We reserve the right to modify these terms at any time. Continued use of MailMonk following any updates constitutes your acceptance of the revised terms.
